it shall appear to the Colonial Government that any

Company registered in Hongkong has published matter

which constitutes an incitement to commit outside the

Colony any act which if committed within the Colony

would be an indictable offence, it shall be lawful for

the Government to call on such Company to show cause

before the Supreme Court why it should not be dissolv-

ed and struck off the register X X X

The Secretary of State is however, advised that

the proposal is open to certain objections, and amongst

them, to the following: which I am to request you to

submit for the consideration of the Secretary of State

for the Colonies.

Such an enactment would permit of a Company being

dissolved and struck off the register at Hongkong if

it had published matter in China which appeared to the

Hongkong Government to constitute an incitement to com-

mit in China (or anywhere elsa but in Hongkong) any act

which, if committed within Hongkong would be an indict-

able offence, irrespective of whether the act if com-

mitted in China or elsewhere than Hongkong were an

indictable or any offence or not.
